Boater Pleads Not Guilty in Crash That Killed Libertyville Boy
The crash that killed 10-year-old Tony Borcia occurred July 28 on Petite Lake in Lake Villa.
David Hatyina pleaded not guilty Monday on a variety of charges in relation to the crash that killed 10-year-old Tony Borcia of Libertyville in July, the Daily Herald reports.
According to the Daily Herald, Hatyina's charges included five counts of aggravated operating a watercraft under the influence of alcohol that resulted in death and four counts of reckless homicide.
Hatyina, 50, of Bartlett, was arrested Aug. 13 by Illinois Conservation Police following an investigation into the July 28 crash that occurred on Petite Lake in Lake Villa.
Ari Fisz, chief of felony review for the Lake County State's Attorney's Office, said after the arrest that Hatyina was under the influence of cocaine and alcohol while operating his 29-foot Baja Outlaw power boat at a high rate of speed.
Borcia was riding an inner tube on Petite Lake in Lake Villa. He was struck by Hatyina's boat after falling off of the inner tube.
Hatyina is free on $1 million bond, the Daily Herald reports, and could face up to 14 years in prison.
